General Application Information

Conservation Commission policy dictates that all applicants are required to meet with the Agent for pre-application project review. Please contact the office to schedule a time to meet either in the office or at the site.

Request for Determination of Applicability (RDA)

WPA Form 1: Request for Determination of Applicability - The Request for Determination of Applicability is a process which provides applicants with the option of seeking a determination on the applicability of the Wetlands Protection Act (the Act) to a proposed site or activity. Before filing this form to confirm the boundary delineation of a resource area, the applicant should discuss other delineation review options with the Conservation Agent.Please use this form when submitting a request to the Assessor's Office. Notice of Intent (NOI)

WPA Form 3: Notice of Intent - To protect the Commonwealth's wetland resources, the Massachusetts Wetlands Protection Act (General Law Chapter 131, Section 40) prohibits the removal, dredging, filling, or altering of wetlands without a permit. To obtain a permit (called an Order of Conditions), a project proponent must submit an application to the Conservation Commission and the Department of Environmental Protection. The Notice of Intent application provides the Conservation Commission and the DEP with a complete and accurate description of the site and proposed activities.

Abbreviated Notice of Intent (ANOI)

WPA Form 4: Abbreviated Notice of Intent - To protect the Commonwealth's wetland resources, the Massachusetts Wetlands Protection Act (General Law Chapter 131, Section 40) prohibits the removal, dredging, filling, or altering of wetlands without a permit. To obtain a permit (called an Order of Conditions), a project proponent must submit an application to the Conservation Commission and the Department of Environmental Protection. The Abbreviated Notice of Intent application provides the Conservation Commission and the DEP with a complete and accurate description of the site and proposed activities. The ANOI simplifies filing requirements for projects which are likely to result in limited impacts to wetland resource areas.

Certificate of Compliance

WPA Form 8A: Request for Certificate of Compliance - Upon completion of the work authorized in an Order of Conditions, the property owner must request a Certificate of Compliance from the Conservation Commission stating that the work or portion of the work has been satisfactorily completed.


Amended Order of Conditions

The Conservation Commission considers an Amendment to be necessary when a proposed change to a permitted project is deemed of sufficient magnitude to require the imposition of additional conditions to ensure adequate protection of wetland resource areas and/or the interests covered under the Massachusetts Wetlands Protection Act and the Fairhaven Wetlands Bylaw. A public hearing, abutter notification, and legal advertisement are required for an Amended Order of Conditions.


Extension of Order of Conditions

Orders are valid for three (3) years from the date of issuance unless an extension is requested by the property owner or applicant and granted by the Fairhaven Conservation Commission. No work can continue or be undertaken under an expired Order of Conditions. If the approved work will not be completed by the permit expiration date, a written request for a permit extension must be submitted to the Commission at least 30 days prior to the permit expiration date.

Abbreviated Notice of Resource Area Delineation (ANRAD)

WPA Form 4A: Abbreviated Notice of Resource Area Delineation - The Abbreviated Notice of Resource Area Delineation provides a way for the applicant to confirm the delineation of a wetland resource area.
